Understand What You Are Signing.

Universal advice; never sign something you don’t fully understand. It appears that the executor is not helpful. The document you have might be a standard part of the probate, or it might be something else. When you don’t understand the paper, it is wise to spend a little money securing a Probate Attorney‘s advice.

Receipt, Release, Refunding, and Indemnification Agreement

You might be holding a Receipt, Release, Refunding and Indemnification Agreement.  These agreements are a probate tool that allows the executor to distribute estate funds to a beneficiary with the promise from the recipient to return the money if it erroneously distributed.  While this document is a regular part of the Probate Process, it could include more. The same form can contain language that, if you sign, means that you agree to take the funds without an accounting and waive your rights to ask future questions.

Executor’s Release of Liability.

At the end of each estate, the executor should receive a full liability release.  But, logically, this should only be given when the beneficiary understands what the executor has done.  Further, the recipient should also understand what he or she is receiving.
