If bankruptcy is the right decision for you, you will need help determining whether you should be filing under Chapter 7 or Chapter 13 of the federal bankruptcy code. Not every person who needs to file for bankruptcy is “broke.” There many high-earning individuals that enter Chapter 13 bankruptcy each day.

Chapter 13 is known as the “wage earners’” bankruptcy. Unlike in a Chapter 7, in a Chapter 13 bankruptcy you do not have to give up your possessions. Instead, in a Chapter 13 your attorney will come up with a “payment plan” that is manageable under your current income level. Your attorney will then present a payment plan to the bankruptcy court for approval.

The beauty of Chapter 13 is that it allows you to keep possession of your property while you are making payments on your bankruptcy payment plan. And as long as you make the required payments over the requisite period of time (usually three to five years depending on the circumstances), then the remaining portion of your unsecured debt is forgiven and you keep all your property.
