Are you or someone you know facing a difficult financial situation? Perhaps someone was furloughed from their job due to Covid-19. Or perhaps someone has mounting credit card debt, large medical bills, personal loans, a lawsuit judgment, or other financial obligations that they are struggling to meet? If this is you or someone you know, it may be time to start thinking of a four-letter. . . help.
You need qualified help to answer questions about how you can move past whatever difficult situation you find yourself in. Should you stop paying creditors? Which ones? Should you try and keep your home? Should you file for bankruptcy? What about your credit score?
These are all big questions with legal consequences. That’s why you need help—legal help. At Silverman Law Office, we are ready to help you. We’ll advise you on your rights and determine if bankruptcy is the right decision for you. Not every difficult financial decision requires filing for bankruptcy to resolve. We’ll help you make that call.
If bankruptcy is the right decision for you, you will need help determining whether you should be filing under Chapter 7 or Chapter 13 of the federal bankruptcy code. Not every person who needs to file for bankruptcy is “broke.” There many high-earning individuals that enter Chapter 13 bankruptcy each day.
Chapter 13 is known as the “wage earners’” bankruptcy. Unlike in a Chapter 7, in a Chapter 13 bankruptcy you do not have to give up your possessions. Instead, in a Chapter 13 your attorney will come up with a “payment plan” that is manageable under your current income level. Your attorney will then present a payment plan to the bankruptcy court for approval.
The beauty of Chapter 13 is that it allows you to keep possession of your property while you are making payments on your bankruptcy payment plan. And as long as you make the required payments over the requisite period of time (usually three to five years depending on the circumstances), then the remaining portion of your unsecured debt is forgiven and you keep all your property.
No matter what your financial situation is, we are ready to help you. Bankruptcy can help distressed debtors move on to the next chapter of their lives with peace of mind, and the Bozeman estate planning attorneys at Silverman Law Office are ready to help you turn the page.
