Glen Ridenour has earned an excellent reputation as the person to turn to for your Orphans’ Court Appeal.
This time, In Re: Estate of Thomas P. Cassidy, the Superior ruled in Glen’s favor.
Background: The grandchildren of the testator’s ex-wife filed a petition for declaratory judgment to interpret the testator’s will. Co-executrices of the testator’s estate filed a cross-petition for declaratory judgment to interpret the testator’s will. The Court of Common Pleas, Bucks County, entered an order denying the grandchildren’s petition, granted the co-executrices’ petition, and subsequently denied the Granchildrens’ motion for consideration.
Holding: The Superior Court found (1) admission of testimony from the testator’s attorney to aid in interpreting the testator’s will was proper, but (2) the determination that the attorney was unable to logically explain the meaning of the distribution scheme in the testators will wasn’t supported by the record. Reversed and remanded with instructions.
