“I am the co-executor of my Mother’s Chester County, Pennsylvania estate, along with her attorney. What fee can he charge?”

Attorney’s Fees in Chester County Pennsylvania

First, if your Mother’s attorney is serving as the executor and will also be providing your mother’s estate legal services in Chester County, the attorney should not be charging both an executor’s fee and a fee for legal services based solely on a percentage of the estate.

Second, Pennsylvania has not adopted a statutory fee for legal or executor services based on a percentage of the estate’s assets, but there is a case, which we refer to as “The Johnson Estate” that spells out a guideline for how attorneys and executors should charge for their services. This is a guideline, not the law.

If a case is much easier or much harder than usual, then the reasonable fee could be much lower or higher than what The Johnson Estate describes.

What we do!

Our firm’s general policy is to bill hourly for services, which I believe is more reasonable. Further, if a client asks me to serve as executor I will ask the client how I should be compensated. Often, they want me to bill hourly. If so, I will document that in the Will itself.

In the end, the attorney’s fee for serving as executor and for legal services to the estate as a probate attorney should be “reasonable”, but how those fees will be calculated…flat fee or hourly…should be agreed to in the beginning.

I contacted Peter through his website using the free consultation link for a question regarding a will. While I was expecting only a few minutes, it was a lengthy conversation. He made sure he understood the situation by asking many questions before offering advice. He then went through my options and results of each one. He left it up to me to decide if I wanted to proceed and did not push me toward one or another. His website has very useful information which I definitely researched before I called him. While I decided not to proceed at this time, I feel I had enough information to make that decision. I would not hesitate to hire him should I need to in the future.

I was referred to Peter after my divorce to put documents together to protect my assets. He suggested a number of documents that would help protect my children and their future. Also, he put together wills, power of attorney and living wills. I initially spoke with him on the phone, he took 30-40 minutes to understand my situation and explain the benefits of having such documents. After a week or two, I met with him in his office and signed the documents. Everything else was remote phone calls and emails. He re-explained these documents and what whom to share. I am in good hands.
