From Our “Ask a Question” Mailbag: Bucks County Will Contest Statute of Limitations

Most Recently Updated August 8, 2018.

“My sister has filed a Will with the Bucks County Register of Wills that is the result of Undue Influence.  I want to Challenge the Will. How long do I have to begin?  Is there a Bucks County Will Contest Statute of Limitations?”

Bucks County Will Contest Statute of Limitations

Pennsylvania Will Contest Statute of Limitations.

Bucks County doesn’t have a specific limit, but the rules that cover the entire state does provide for a limitation. If you are an interested party, you have one year from Will’s filing to appeal.  You are contesting the Wills filing and its validity.

File Sooner Rather Than Later.

Filing sooner rather than later is usually the best, as the Executor might be selling or distributing assets.  Once appointed Executor, your sister has broad powers and virtually no oversight.  If she spends the estate’s funds, we might find them difficult or impossible to recover.

Discover the Date of the Will’s Filing.

A call to the Register of Wills should provide you with the date of the Will’s filing. Depending on your specific timeline, and whether the one-year statute of limitations has already passed, your options may vary or be non-existent.

The Best Option, Act before the Will’s Filing.

If the Will is unfiled, we can act as your  Bucks County Will Contest Lawyer and file a caveat with the Bucks County Register of Wills. Doing this prevents someone from obtaining Letters Testamentary until you have the chance to review the Will and decide if you are going to contest the will.

I knew I needed to update my Estate Planning documents created 15 years ago, yet I kept putting it off. Peter, in his no pressure way nudged me to finally check it off my list. The admin staff of Klenk law were very respectful and responsive in working with me to set up dates and times that work for me to talk with Peter over the phone regarding what I wanted to update. Peter answered my questions and explained some things to me. This helped me on some of my estate decision. After our phone talk, I received a draft of the updated documents, and was allowed ample time to review them prior to a final review with Peter over the phone. This pre-signing reviews made the in-person signing time very short. I would highly recommend Klenk Law, because Peter and his staff were professional but friendly, and thorough in the estate planning work they did for me. Thank you, Peter!
