The Process of Challenging a Will

Standing
Not just anyone can file a Will Contest. You must prove that you have a “dog in the fight.” If the Will you Challange is found invalid, you must have more money in your pocket than you would otherwise. The burden of proving the case falls mainly on the challenger. You have made a claim; now you must prove it. You may need to gather and then submit medical records, deed filings, private documents, and maybe even Facebook entries.
Some areas require expert testimony—handwriting experts, forensic accountants, and doctors. To admit medical records, a doctor must often testify. Accountants and CPAs are essential if the case involves complex financial transactions. A handwriting expert’s testimony will be required if the challenge is based on forgery.
